Levine Act Disclosure Requirement for Parties to a Proceeding

The Levine Act mandates that a Party engaged in a Proceeding before the City of San Mateo, involving actions related to their contract, license, permit, or entitlement for use, must disclose any campaign contributions exceeding $250 made to City elected or appointed officials within the preceding 12 months before the City’s decision. A Participant in a Proceeding can voluntarily disclose campaign contributions using this form and submit it to clerk@cityofsanmateo.org.

When to Complete The Levine Act Form

The form should be completed (1) by the party engaged in a contract with the City of San Mateo (“City”) (or its representative) when submitting a response to a Request for Proposals or any competitive solicitation, initiating contract negotiations with the City, or finalizing a contract with the City, whichever occurs first, or (2) by a party involved in a license, permit, or other entitlement process before the City at the time of submitting the license, permit, or entitlement application to the City (or their representative). This requirement applies if a party (or its representative) has made contributions totaling more than $250 to a City Council member or other appointed parties potentially participating in the proceeding within the previous 12 months of the proceeding.

The party (or its representative) must file a supplementary form for any new reportable contributions made while the contract, license, permit, or other entitlement is under consideration.

Additionally, the party (or its representative) should utilize this form to rectify any previously submitted forms.
