The COVID-19 Tenant Relief Act (SB 91) – an extension of the statewide eviction moratorium provided in AB 3088 – was signed into law on January 29, 2021. The Senate Bill protects tenants from evictions based on nonpayment of rent due to the impacts of the COVID-19 pandemic and will be in effect from February 1, 2021 to July 1, 2021.

City & County Emergency Ordinances Impose Moratoriums on Evictions for Non-Payment of Rent

In response to the hardships many in our community are facing due to the economic impacts of the COVID-19 outbreak and the health orders, moratoriums were in effect in 2020 to ban residential and commercial evictions in the City of San Mateo.

The San Mateo City Council and County Board of Supervisors each adopted emergency ordinances that prohibited evictions for nonpayment of rent by tenants who were impacted by the COVID-19 pandemic. Between the County and City ordinances, renters of any type of residential property, and small businesses tenants were protected in the City of San Mateo. The ordinances allowed for a deferral, not a waiver of rents.

  • City Adopts Emergency Ordinance Imposing a Moratorium on Commercial Evictions
    The San Mateo City Council adopted an emergency ordinance (English, Spanish) imposed a ban covering commercial evictions. The moratorium expired Sept. 30, 2020, however tenants may have up to 12 months to repay rent. 
  • County Board of Supervisors Adopts Emergency Ordinance Imposing a Moratorium on Residential Evictions
    The County Board of Supervisors placed a moratorium on residential evictions for nonpayment of rent that applies throughout the cities and towns of San Mateo County. The ordinance ran through Aug. 31, 2020.

The ordinances require landlords to notify tenants of the moratorium before attempting to take any action to evict a tenant.

Key Features of Ordinances

The City of San Mateo has a robust community of small businesses, and nearly half of its residents are renters. Key features included:

  • During the local emergency landlords are prohibited from evicting tenants who are unable to pay rent due to a financial hardship caused by COVID-19
  • Tenants must notify their landlord and demonstrate a connection to COVID-19
  • Protections would apply to nonprofits, and commercial tenants with annual gross receipts of less than $25 million
  • Tenants are still required to pay back rent, and may have up to 12 months after the emergency is lifted
